Department for Education
The Department forEducation aims to make this
the best place in the world for children and young people to grow up.
The Department's priorities (contained in the comprehensive Children’s
Plan published in December 2007) are:
·to secure the wellbeing and health of children and young people
·to safeguard the young and vulnerable
- individual progress and system reform to achieve world class standards
and close the gap in educational achievement for disadvantaged children
- to ensure that young people are participating and achieving their potential
to 18 and beyond
- keeping children and young people on the path to success
Work of the Legal Team
DFE lawyers are employed by TSol but are located
within their clients. Lawyers provide legal services to assist and support
the Departments in achieving their objectives. They work in close partnership
with policy and operational colleagues, applying their legal professional
skills to getting their Departments’ business done. They do extensive
legislative work on both Bills and SIs, as well as a very wide range of
advisory work..
In particular lawyers:
· work closely with policy colleagues as policies
are developed which may lead to legal changes;
· provide legal support to colleagues and Ministers
in relation to Bills, instructing parliamentary counsel and supporting
the Parliamentary process
· draft secondary legislation to implement Acts,
such as regulations and orders;
· advise on litigation in which the Department
is involved; and
· adviseDepartmental colleagues on a wide range
of legal issues they encounter in their day-to-day work, including in
relation to corporate issues such as employment law, information law and
procurement .
Examples of recent work include:
· 3 separate Bills in the 07-08 parliamentary
session: to sell the student loan portfolio, improve outcomes for children
in care and raise the “participation age” to 18
· SIs to implement the Childcare Act (regulating
early years provision) and the Safeguarding Vulnerable Groups Act (the
Government’s response to the Soham murders and the need to safeguard
children)
- legal support for the Government’s Academies
programme, where every Academy is governed by a contract with government
- implementing the EU directive on the Mutual Recognition
of Professional Qualifications for the education sector
